Preliminary Hearing Waived in Non-Fatal Shooting Over Parking Dispute

A shooting defendant waived his right to a preliminary hearing detailing the evidence against him, and was denied release before DC Superior Court Judge Lloyd Nolan on July 14. 

Juwan Russell, 28, is charged with assault with a dangerous weapon, possession of a firearm during a crime of violence, and destruction of property less than $1,000 for his alleged involvement in a non-fatal shooting that occurred on June 25, on the 1000 block of 16th Street, NE. 

According to court documents, two individuals got into an argument over a parking spot when the defendant pulled a gun and allegedly began to shoot in the victim’s direction. The victim was not hit, but his vehicle was damaged.

Russell’s defense attorney, Lisbeth Saperstein, waived his right to a preliminary hearing, then proceeded to argue for Brown’s monitored release. 

Saperstein emphasized Russell’s lack of criminal and bench warrant history. She also noted that his mother, fiance, and best friend were all present in court to support him. 

Additionally, given the fact that Russell is a neighbor of the victim, Saperstein stated that Russell would be able and willing to live with his mother if it were required as a condition of his release. 

The prosecution, on the other hand, emphasized the seriousness of the charges against Russell. They stressed to the court that he allegedly fired a gun in “basically broad daylight”. 

They also noted Russell’s actions were the result of a parking dispute. The prosecution argued that this was a significant action for a “relatively insignificant reason,” and was proof of the danger which Russell poses to the community. 

The prosecution further highlighted the strength of the evidence against the defendant, which includes CCTV footage, witness interviews, and the firearm which was found upon searching the defendants’ residence. 

Judge Nolan ordered that Russell continue to be held in custody. 

Parties are set to reconvene on July 29.
